Terms of Service

You agree to use My3chos only for lawful personal purposes. You must not:

• —Use any Echo for impersonation, fraud, harassment, defamation, or any attempt to deceive a third party into believing they are communicating with the actual person an Echo represents.
• —Upload, submit, or generate content that is illegal, obscene, threatening, discriminatory, or that infringes the intellectual property rights of any third party.
• —Attempt to reverse-engineer, scrape, or extract model weights, voice models, or source data from the platform.
• —Use the Service for commercial resale or to build competing products without our express written consent.
• —Create an Echo of any living person without that person’s explicit consent.

We reserve the right to suspend or terminate accounts that violate these restrictions, at our sole discretion and without prior notice.

A Reconstruction Echo is built from materials contributed by family members or estate representatives of a deceased individual. By creating or contributing to a Reconstruction Echo, you represent that:

• —You are an immediate family member, legal next of kin, or authorized representative of the deceased person’s estate.
• —You have the authority to submit the materials you provide (letters, photos, audio recordings, documents) on behalf of the deceased and their estate.
• —You will use the resulting Echo solely for personal remembrance and family connection, not for any commercial purpose or in any way that would dishonor the deceased’s memory or reputation.

MyEcho LLC does not verify the authority of contributors and is not liable for disputes arising between family members or estate parties regarding the creation or use of a Reconstruction Echo.

Setup fees: A one-time setup fee is charged when you create an Echo. Setup fees are non-refundable once Echo creation has begun (interview data has been submitted or voice processing has started).

Recurring subscription: After setup, your Echo requires an active monthly or annual subscription to remain accessible. Subscriptions are billed in advance and renew automatically until cancelled.

Hibernation: If a payment fails or your subscription is not renewed, your Echo enters Hibernation. During Hibernation:

• —The Echo is inaccessible but your data is fully preserved for 12 months.
• —You may reactivate at any time within that 12-month window by resuming your subscription.
• —After 12 months, we will contact you at the email on file. If we receive no response or payment, data may be permanently deleted. Deletion is irreversible.

Prepay plans: 5-year and 10-year prepaid plans are available. Prepaid amounts are non-refundable except as required by applicable law.

Extended archive add-on: Available for any tier at $1.99/month for unlimited storage beyond the included tier allocation. Cancellation of the add-on reverts storage to the tier default; files exceeding that limit will be flagged for review.

We reserve the right to adjust pricing with 30 days’ notice to existing subscribers.

To the maximum extent permitted by applicable law, MyEcho LLC, its officers, directors, employees, and agents will not be liable for:

• —Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or emotional distress.
• —Any damages arising from reliance on Echo responses, which are AI-generated and not guaranteed to be accurate.
• —Data loss resulting from Hibernation expiration or technical failures, beyond the data preservation obligations stated in Section 5.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid to us in the 12 months preceding the claim.

Your content: You retain ownership of all materials you upload (interview responses, photos, documents, audio). By submitting content, you grant MyEcho LLC a limited, non-exclusive license to process and store that content solely for the purpose of operating your Echo.

Our platform: The My3chos platform, ZH verification system, software, design, and brand are owned by MyEcho LLC and are protected by copyright, trademark, and other intellectual property laws.

By you: You may cancel your subscription at any time through your account settings. Cancellation stops future billing and puts your Echo into Hibernation as described in Section 5.

By us: We may suspend or terminate your access immediately, without notice, if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination for cause, we are not obligated to preserve your data beyond any applicable legal requirement.

Sections 6, 7, 8, and 10 survive termination of these Terms.
